Terms and Conditions of Sale

These General Conditions of Sale govern purchase contracts concluded between Moon Bike S.r.l. and Customers through the e-commerce website www.moonbikesrl.it and authorized marketplaces.

By placing an order, the Customer declares to have read, understood, and fully accepted these Terms.

2. Object of the Contract

Moon Bike trades in:

  • Original and aftermarket spare parts for motorcycles, scooters, and mopeds
  • Motorcycle accessories (bags, mounts, communication systems)
  • ECE 22.06 approved helmets
  • Technical apparel and protection
  • Lubricants, batteries, and maintenance products

All products are new, original, and compliant with current safety and homologation regulations.

3. Order Procedure and Conclusion of the Contract

  1. The Customer selects the products and adds them to the cart.
  2. Enters billing and shipping details.
  3. Chooses the payment method and confirms the order.
  4. Receives an order confirmation email with a summary of products, prices, shipping costs, and estimated delivery times.
The contract is concluded upon sending the order confirmation via email. The confirmation constitutes acceptance of the order by Moon Bike.

4. Prices and Payment Methods

Prices are expressed in Euros (€), including VAT. Prices may vary without notice; the price indicated at the time of order confirmation is binding.

Moon Bike does not store credit card data. All payments are managed through secure PCI-DSS certified gateways.

5. Product Availability

In case of unforeseen unavailability after order confirmation, the Customer will be informed within 48 hours with a proposal for:

  • Equivalent alternative product
  • Waiting for replenishment (with estimated times)
  • Immediate full refund

6. Shipping and Delivery

Couriers used: BRT • Poste Italiane • DHL

Non-EU 10–20 business days (subject to customs clearance)

Damaged package upon delivery? Accept with reservation, photograph the package and contents, and contact us within 24 hours to open a compensation claim.

7. Right of Withdrawal (14 Days)

The consumer Customer has the right to withdraw within 14 days of receiving the product, without stating any reason, in accordance with the Consumer Code (Legislative Decree 206/2005).

How to exercise it:

  1. Communicate the intention via email to info@moonbikesrl.it within 14 days
  2. Return the product undamaged, unused, in its original packaging
  3. Ship to our warehouse (shipping costs borne by the Customer)

Refund: within 14 business days of receiving the return, using the same payment method. Original shipping costs are non-refundable (unless due to our error).

Exclusions from the right of withdrawal:

✗ Helmets with open seal (hygiene reasons)
✗ Technical apparel worn or washed
✗ Lubricants and liquids with open seal
✗ Customized or specifically ordered spare parts

8. Legal Guarantee of Conformity (24 Months)

All products are covered by a 24-month legal guarantee of conformity from delivery (Art. 128 et seq. of the Consumer Code).

9. Personal Data Protection (GDPR)

Personal data is processed in compliance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003. Data Controller: Moon Bike S.r.l.

Data is collected for: order and shipment management • invoicing • customer assistance • marketing (only with consent). The Customer has the right to access, rectify, erase, and portability of data.

10. Intellectual Property

All content on the site (texts, images, logos, graphics) is the property of Moon Bike S.r.l. or their respective owners and is protected by copyright. Unauthorized reproduction is prohibited.

11. Limitation of Liability

  • Delays attributable to the courier or force majeure
  • Indirect damages resulting from the use of products
  • Incompatibility due to incorrect data provided by the Customer
  • Site malfunctions due to external causes

12. Dispute Resolution

Competent Court: Court of Naples for disputes with professionals; court of the consumer's residence for disputes with consumers.

13 & 14. Amendments and Applicable Law

Moon Bike reserves the right to amend the Terms at any time. Amendments do not affect already confirmed orders.

The contract is governed by Italian law.
